The important part first: Almighty shows live data from public sources, which can be late, incomplete or wrong. Enjoy it, learn from it, but never rely on it for navigation, travel or safety.
1. About these terms
These terms apply when you use the Almighty: Live Globe Tracker app ("Almighty") and this website. Almighty is provided by Bonny James, an individual developer in the United Kingdom ("we", "us"). If you downloaded the app from Apple's App Store, Apple's Licensed Application End User License Agreement also applies. If the two conflict, Apple's agreement wins for the licence to use the app. Our Privacy Policy explains how we handle personal data. By using Almighty you agree to these terms.
2. What Almighty is
Almighty is a free app for exploring live public information on a 3D globe: aircraft, satellites, earthquakes, wildfires, storms, weather imagery, news locations, the night sky, and more. We may add, change or remove features and data sources at any time, for example when a data provider changes its terms or stops publishing. Some features may become paid in future. If so, the price and terms will be shown before you buy, and features you already have for free won't be taken away without notice.
3. Not for navigation or safety
Everything shown in Almighty comes from third parties and is provided "as is". Positions can be delayed or estimated, aircraft and other objects can be missing or wrongly identified, and reports can be out of date. Do not use Almighty for navigation, flight planning, aviation, maritime or travel decisions, emergency response, or any situation where a mistake could cause harm. In an emergency, follow official warnings and contact the emergency services.
4. Data from other organisations
Almighty's data comes from public and open-data providers, credited in the app under Settings → Data & Credits. Those organisations do not endorse Almighty and make no promises about the data. This includes the transport and road agencies whose feeds we show. Their data is provided "as is", and they are not responsible for Almighty. Airline, agency and other names and logos belong to their owners and are used only to identify them.
5. AI answers
Some questions are answered by an AI service, only if you agree (see the Privacy Policy). AI answers can be wrong or incomplete, and are not professional advice. Check anything important with a reliable source. The number of AI questions per day is limited.
6. Your account
You don't need an account, and there is no sign-in. If you use AI answers or report a story, the app is given an anonymous app ID (see the Privacy Policy). You can delete it at any time in Settings → Account.
7. Using Almighty fairly
Please don't:
- use Almighty to stalk, harass or follow private individuals, or to plan anything unlawful;
- copy or harvest Almighty's data in bulk, or use automated tools to access our servers;
- overload, disrupt, or try to get around the limits or security of our servers;
- copy, change or reverse-engineer the app, except where the law allows it or an open-source licence says so;
- send false or abusive reports.
We may limit or stop access for anyone who breaks these rules.
8. Things you send us
When you report a news story or send us feedback, you allow us to use it to review content and improve Almighty.
9. Links to other websites
News articles and other links open websites we don't control. Their own terms and privacy policies apply, and we're not responsible for their content.
10. Ownership
The app, its design and its original content belong to us. Open-source software in the app is used under its own licences, listed in Settings → Open-source licences. Data belongs to its providers and is used under their terms.
11. Our responsibility to you
We provide Almighty with reasonable care and skill, but we can't promise it will always be available, error-free, or that the data will be accurate. To the extent the law allows, we are not responsible for losses caused by relying on the data (see section 3), for losses that were not foreseeable, or for business losses. Otherwise, our total responsibility to you is limited to £100 or the amount you paid us in the last 12 months, whichever is higher.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or anything else that cannot be limited by law, and nothing affects your legal rights as a consumer.
12. Ending
You can stop using Almighty at any time by deleting the app (and your account, if you have one). We may stop offering Almighty. If we do, we'll try to give reasonable notice in the app.
13. Changes to these terms
We may update these terms, for example when features or the law change. We'll update the date at the top and, for significant changes, tell you in the app. If you keep using Almighty after that, the new terms apply.
14. Law
These terms are governed by the law of England and Wales, and the courts of England and Wales can hear disputes. If you live in Scotland, Northern Ireland, the EU or elsewhere, you keep the protection of your local consumer law and can bring a claim in your local courts.
15. Apple
These terms are between you and us, not Apple. Apple is not responsible for Almighty or its content, has no obligation to provide support for it, and is not responsible for any claims about it (including product liability, legal compliance, or intellectual property claims). Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
